By placing an order on the Herclos website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Sale (“Terms”). These Terms are intended to ensure a clear, transparent, and secure purchasing relationship between you (“Customer,” “you”) and Herclos (“Herclos,” “we,” “us,” “our”).
1. Product Information
The key features of each product are displayed on its product page. We make reasonable efforts to ensure that product photographs, descriptions, and technical information are accurate. However, slight variations in color or appearance may occur due to differences in screen settings and display quality. Such variations do not constitute a defect and do not justify a claim, return, or refund, provided the product otherwise conforms to its description.
2. Order Placement; Acceptance
Placing an order on the website constitutes an offer to purchase the selected product(s) subject to these Terms. Your order is deemed accepted only when (i) payment has been successfully authorized and received and (ii) we have sent you an order confirmation and/or shipping confirmation email.
We reserve the right to refuse, suspend, or cancel any order at any time if we reasonably believe there is a payment issue, incomplete or inaccurate Customer information, suspected fraud, unauthorized activity, or violation of these Terms. We may request additional information to verify your identity or order details before processing.
3. Pricing; Taxes; Shipping Charges
All prices are displayed in dollars (US and Canadian dollars) and include applicable taxes (where indicated). Shipping fees and any additional delivery charges are clearly shown prior to final order submission.
We may change our prices at any time; however, the price charged will be the price displayed at the time your order is placed (excluding errors as described below).
Pricing errors. If a product is listed at an incorrect price due to a typographical, technical, or other error, we reserve the right to cancel or refuse any order placed for the product at the incorrect price. If your payment has already been processed, we will issue a refund.
4. Payment
Payment is due in full at the time of order placement via credit/debit card or any other secure payment method offered on the website. Transactions are processed by approved payment service providers using secure systems. We do not consider an order final until payment is successfully authorized and received.
5. Shipping; Delivery; Tracking
We ship to United States and Canada.
Estimated delivery times (business days):
- Standard shipping: 4 to 9 business days
- A tracking number will be emailed to you once your order ships.
Delivery times are estimates only and are not a guarantee. Actual delivery may vary due to carrier operations, customs processes (where applicable), peak periods, weather, or other circumstances beyond our reasonable control.
6. Returns; Refunds (60 Days)
Subject to the conditions below, you have thirty (60) days from the date of delivery to request a return in accordance with our refund policy.
To be eligible for a return, items must be:
- in perfect condition,
- unused, and
- returned in their original packaging.
Return shipping. Return shipping costs are the Customer’s responsibility, unless otherwise required by applicable law.
Inspection; refund method. Once we receive the return, we will inspect the item. If approved, we will refund the purchase price paid for the returned product(s), excluding the original shipping charges. Refunds are issued to the original payment method.

8. Order Changes; Cancellations
If you need to change or cancel an order, please contact Customer Support as soon as possible. We will attempt to accommodate requests, but we cannot guarantee changes or cancellations once an order has been processed or shipped.
9. Customs; Duties; Import Fees (If Applicable)
For shipments to any destination where applicable, your order may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by local authorities. These charges are the Customer’s responsibility and are not included in the product price or shipping fees unless expressly stated otherwise.
10. Title; Risk of Loss
Title to the products and risk of loss transfer to the Customer upon our delivery of the products to the carrier (unless applicable law requires otherwise). If a package is marked as delivered by the carrier but is missing, please contact us promptly so we can assist with a carrier inquiry.
11. Disclaimer; Limitation of Liability
To the maximum extent permitted by applicable law, Herclos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising out of or related to the purchase or use of the products.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including certain statutory rights for consumers).
12. Force Majeure
We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including carrier disruptions, strikes, natural disasters, war, governmental actions, or interruptions to utilities or networks.
13. Governing Law; Disputes
These Terms are governed by the laws of the United States and Canada, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts, unless mandatory consumer protection rules provide otherwise.
